The Role of a Private Judge in Child Custody Disputes

Flicker Kerin, LLP

Child custody battles can be among the most emotionally charged and legally complex disputes in family law. When parents separate or divorce, reaching an agreement on where the children will live and how decisions will be made can feel overwhelming. These cases often unfold against a backdrop of conflict, mistrust, and competing visions for a child’s future. In California, however, there is a powerful alternative to drawn-out courtroom battles: private judging. A temporary private judge offers a fair, efficient, and child-focused approach to resolving custody disputes—away from the stress and delays of public courtrooms.

What Is a Temporary Private Judge?

A temporary all-purpose private judge is a neutral third party—often a retired judge or experienced attorney—who is jointly selected by the parties to act as a decision-maker in their case. In California, parties can agree to use a private judge under California Code of Civil Procedure §638. Once appointed, a private judge has nearly all the same powers as a sitting judge in the Superior Court. They can preside over hearings, rule on motions, and issue binding orders.

A private judge’s rulings carry the same legal weight as those of a traditional court judge. The difference is that the entire process unfolds outside of the public court system.

Why Parents Choose a Private Judge in Custody Matters

There are many reasons parents turn to private judging during custody disputes, especially in high-conflict or high-net-worth situations. Public family court systems are often overloaded, meaning parties may face months of delay just to get a hearing date. When they finally appear in court, they may be limited to short time slots and rushed hearings with judges who are unfamiliar with the details of their case or new to family law.

Private judges offer a solution. They can dedicate the time and attention needed to understand the nuances of a family’s situation. This is particularly important in custody cases, where decisions must reflect the best interests of the child. High-profile individuals, business owners, and professionals also appreciate the experienced professionals that this approach provides, as well as the ability to avoid the public nature of hearings at the courthouse where other litigants are present.

How the Private Judge Process Works in Custody Disputes

The process begins when both parties agree to appoint a temporary private judge and file a stipulation with the court setting forth the terms of the temporary private judge’s appointment. This agreement gives the private judge authority to preside over the case. From that point forward, the private judge manages all custody-related proceedings as agreed-upon in the appointment order, from pre-hearing motions to trial and post-judgment modifications.

Hearings take place in a secluded setting—often at the private judge’s office, a law office, or other neutral meeting space—and can be scheduled at times convenient for both parties. The private judge listens to testimony, reviews evidence, and issues rulings that are then entered into the public court record and enforced like any other judicial order.

Importantly, a private judge can also address discovery disputes, oversee temporary orders, and remain involved in future custody modifications, offering long-term continuity that is rare in public courts.

Custody Hearings Behind Closed Doors: A Confidential Advantage

One of the strongest appeals of private judging in custody disputes is the additional privacy it affords. In public court, custody hearings are often accessible to observers. When working with a temporary private judge in California, the proceedings are held outside of the public courthouse.

This additional level of privacy is especially critical in cases involving allegations of abuse, mental health issues, substance use, or disputes over special needs parenting. It protects not only the parents’ reputations but also the emotional well-being of the children, who may otherwise be exposed to embarrassing or traumatic information.

For families in the public eye, or those managing complex financial affairs, private judging adds a layer of privacy to protect their personal and professional details.

A Child-Focused Approach: Prioritizing Best Interests

Private judges are uniquely positioned to take a thoughtful, child-centered approach to custody disputes. They typically have deep family law experience and understand that each child’s situation is different. Rather than applying a one-size-fits-all model, a private judge can explore creative parenting plans tailored to the child’s age, schedule, emotional needs, and family dynamic.

In many cases, private judges will work closely with parenting coordinators, custody evaluators, or therapists to make fully informed decisions. They also have the time to engage meaningfully with both parents, allowing for a more nuanced view of each party’s strengths and concerns.

Because a private judge remains consistent across hearings and phases of the case, there is a continuity that promotes stability for the child—something that’s often lacking when families face rotating public judges.

Comparing Private Judges to Other Custody Resolution Options

There are several alternatives to public court litigation in custody matters, and it’s important to understand how private judging compares.

Mediation is a collaborative, non-binding process where a neutral third-party helps parties reach an agreement but cannot issue rulings. Recommending Mediation allows the third-party to make a recommendation when the parties cannot agree. The recommendation is not binding until the Court issues an order implementing the recommendation. Arbitration, when a neutral third-party makes a binding decision, is limited to specific family law issues. The final decisions on custody, visitation, and support are reserved for a judge.Traditional court hearings are authoritative but often delayed, impersonal, and can lack privacy.

Private judging blends the best of all worlds. It provides the authority of a sitting judge, the personalization of mediation and other methods of alternative dispute resolution, and the flexibility to resolve matters efficiently, with far greater attention to detail.

Is a Private Judge Right for Your Custody Case?

While private judging offers many advantages, it’s not a one-size-fits-all solution. It’s more effective in custody disputes where the stakes are high, the issues are complex, and both parties are motivated to resolve matters outside the public courtroom. If your case involves repeated conflict over parenting schedules, decision-making authority, child-parent contact issues, or relocation, a private judge can provide the continuity and structure that public courts often lack. These professionals are especially valuable when the case touches on mental health concerns, substance use allegations, or disputes over a child’s medical, educational, or developmental needs.

Private judging is also a smart choice for families with substantial marital estates or high public visibility. In these situations, increased privacy is key. Keeping as much sensitive information as possible—from financial statements to personal testimony—out of the public eye can protect reputations and ease stress for both parents and children. Similarly, cases that involve multiple ongoing disputes, such as property division, spousal support, and custody, benefit from having a single decision-maker familiar with all aspects of the case.

However, there are situations where private judging may not be appropriate—or may require additional precautions. Cases involving a significant power imbalance between the parties, particularly when there’s a history of domestic violence or coercive control, demand a careful approach. While private judges are bound by the same legal and ethical standards as sitting judges, the sequestered setting can sometimes lack the institutional protections found in public courtrooms. Without safeguards, one parent may feel pressured to agree to terms or may struggle to advocate effectively for themselves or their children.

In these cases, the decision to use a private judge should be made with the support of legal counsel who can evaluate whether the environment will be safe, fair, and conducive to a just outcome. Protective measures such as using separate spaces, remote proceedings, or involving a minor’s counsel may help level the playing field. But ultimately, the process must prioritize the well-being of the child and ensure that both parents have a meaningful opportunity to be heard.

If you’re considering private judging, the key question is whether the process will serve your family’s needs better than the public system. When properly structured, this approach can offer a more responsive, respectful, and child-focused path through a difficult time.

The Role of Legal Counsel in Private Judging

Even with a private judge, strong legal advocacy is essential. Your attorney will prepare the case, represent your interests at hearings, and help you negotiate or litigate parenting plans. An experienced family law attorney understands how to work within the process to ensure your child’s needs—and your rights—are protected.
